ABOUT ME

Hey,

I'm Evangeline Rose, currently diving into the world of law and technology at National Forensic Sciences University in Gandhinagar. Originally from Kozhikode, Kerala, I've always been intrigued by how these two fields intersect.

My educational journey began at Mar Baselious English Medium School, Engapuzha , where I laid the foundation for my studies until the 8th grade. Moving on to Alphonsa Senior Secondary School, Thamarassery, I delved deeper into the realms of science and computer science, completing my higher secondary education there.

Enrolling in the BSc LLB program at National Forensic Sciences University was a big step for me. Here, I'm exploring the ins and outs of forensic sciences and legal studies while learning how technology shapes these fields.

Outside of class, I love diving into books, especially literature, and unwinding with some good music. These hobbies keep me balanced and refreshed as I tackle my studies.

Ultimately, I hope to use what I learn here to make a positive difference in the world. By understanding how law and technology work together, I want to help create a fairer and more just society.

Caveat Emptor: Let the Buyer Beware

In the whirlwind bustle of commercial life, where deals are made and changed as often as words in a conversation, an ancient rule still applies—one that every resourceful buyer should have in mind: caveat emptor. The maxim is derived from Latin and can be translated as "let the buyer beware." But what is actually meant by it in a contemporary sense, and how is this rule being interpreted today? In other words, caveat emptor places the burden of discovery on the buyer; it is upon the buyer to make every possible effort in seeking and examining a product before making a purchase. The underlying point is that the buyer should make sure that the product which they desire is exactly to their expectations and specifications. If after making a purchase the product is in some way deficient or misrepresented, a buyer could not impose any liability upon the seller. The principle, in fact, prescribes the due diligence that buyers must do, depending on their own judgments when evaluating...

Understanding the Legal Maxim "Actus legislation nemini facit injuriam"

In the vast landscape of law, one encounters a profusion of  Latin maxims , each holding profound significance in guiding principles of law and doctrines. Of them all, "Actus legislation nemini facit injuriam" stands as a fundamental concept that encloses the  fairness and justice in the realm of legal procedure.  The maxim is translated as  "the act of the law does injury to no one." It reinforces the principle by stating that no individual should suffer harm as a direct result of lawful actions by the judiciary. In other words, it establishes that legal procedures should not unjustly prejudice any individual.  The literal interpretation of the maxim is that no one is prejudiced by a judicial action and legitimate action does not need any qualifications. There is a prevalent assumption that initiating a lawsuit against another party will not affect the second party (other than a frivolous action). T he maxim suggests that the legal procedures should not harm an...

Actori Incumbit Onus Probandi

Have you ever wondered why offenders in controversial cases aren't immediately jailed? The explanation lies in the legal principle known as "Actori Incumbit Onus Probandi," which translates to "the burden of proof is on the plaintiff." This maxim means that to win a lawsuit, the plaintiff must provide sufficient evidence to substantiate their claims. Simply filing a case doesn't guarantee a victory; the plaintiff must convincingly establish the defendant's act or omission that caused the plaintiff's loss. This principle has historical roots in ancient Roman law, where it was expressed through maxims like "ei qui affirmat non ei qui negat incumbit probatio" (the burden of proof is on the one who affirms, not on the one who denies) and "actori incumbit probatio" (the claimant bears the burden of proof). Similarly, in Islamic law, the burden of proof typically rests on the claimant. In civil cases, the plaintiff must present substant...
